Professor Layton - Dude hasn't had a game in quite some time, especially since Level-5 has been working on Yokai Watch more recently

I saw Curious Villager counter the Layton point, but I'll throw my two cents in as well.

As mentioned, his series is still going on, with Layton's Mystery Journey, a new game starring his daughter Kat, in 2017 and an upcoming Switch port this year. The Professor himself is not in the base game, but he is mentioned a lot and appears in the associated anime. He's also still listed on Nintendo UK's character hub as a major franchise, before Kirby, Metroid, or Donkey Kong.

Also, while he didn't do super well on the ballot from the polls we've seen, it has been noted that the ballot also asked the gender of the voter (which one imagines they'd factor in when trying to maximize roster appeal), and Layton's playerbase is largely female (in fact, the newest game switched from the Professor as the protaginist to his daughter because of that). Plus, if we assume SSB4Dojo's results are within the ballpark of accuracy, then he polled better then any character from Resident Evil, Tales of, Frogger, SMT/Persona, Tekken, Devil May Cry, Monster Hunter, and Ninja Gaiden. His franchise is also bigger then one might think, as while sales data obviously isn't a major factor in Smash representation, it has sold 15 million units in total, which isn't anything to sneeze at for a DS/3DS exclusive puzzle game series.

The main disadvantage he has is that his games are no longer being localized by Nintendo, with Level-5 publishing Mystery Journey themselves and bringing it to cell phones in addition to the 3DS. He also has competition in terms of Yo-Kai Watch (who did poll considerably better then him in Japan), but that series has flopped super hard outside of Japan, and it appears that worldwide notoriety is still important for third parties.

I'm not expecting him to be in the game (or at least not playable), and he's still a bit of a pipe-dream, but I wouldn't be that quick to dismiss him.

Mona is a good wildcard choice for Smash, she has yet to been seen in the game so its likely if we are to get another Warioware character especially considering everybody loves the Mona Pizza theme.. And Warioware Gold just came out recently so she could promote that so Wario can make more money

One more thing worth mentioning, the storyline of Warioware Gold is literally Wario hosting a "Smash tournament" with his micro games.
