Tbh for smash at least a creator saying a character iisn't in is like, 99% a disconfirm, or at least I think it's best to treat it that way.
Truth is we don't actually know what the rules of Nintendo's NDAs actually are, they could be "don't say this character is in the game" to "don'tt alk about this character in relation to smash at all". I'm certainly not a lawyer and I doubt anybody else here is too.

The individual who disconfirmed Master Chief did not create the character, and has actually lied in the past specifically to allow reveals to be a surprise.

I'm not saying Chief is in, but it's not impossible.
