It really only makes sense that Tom Nook's in the background, even if he were to be playable. As Sakurai said, the people in the Smashville background are sort of like spectators at a sporting event. Tom Nook's loyal to his town, right? If he's not in the match, why shouldn't he go out there with the rest of his town and support the fighters?
Also, I'm not liking the moveset in the original post.

A - Jab
AA - 1-2 Punch
AAA- 1-2 Punch to Kick
Ftilt - Tail Stab
Dtilt - Tail Sweep
Utilt - Upward Headbutt
FSmash - Axe Slash
USmash - Crescent Axe Slash
DSmash - 360 Axe Sweep
Nair - Sex Kick
Bair - Backward Tail Alap
Fair - Frontflip Headbutt
Uair - Frontflip Overhead Kick
Dair - Drill Kick
Grab - Fishing Rod (Also used for Tether Recovery)
Grab A - Slap
Fthrow - Forward Release
Bthrow - Backward Release
Uthrow - Upward Release to Slingshot Barrage (Nook throws the enmy up above him and release a flurry of slingshot pellets in his direction)
Dthrow - Pinwheel Pulverizer (Nook slams the enemy onto the ground below him, causing them to bounce up above him. He then pulls out a spinning pinwheel, and stabs directly above him into the enemy. The pinwheel traps the enemy and gradually damages him for a second before sending him flying diagnally downward behind Nook.)
B - Slingshot (Chargeable a la Link's arrows)
Smash B - Plant (Tom digs a hole directly under the enemy, trapping them in the ground. If an enemy is not in range, Tom Nook simply thrusts his shovel out blankly, not doing any damage. Similar to DK's Smash B.)
Up B - Balloon Trip (Tom pulls out three balloons and begins sailing upward. The balloons can be popped by enemy attacks and projectiles. He'll continue floating until either all the balloons are popped or the player cancels the move by pressing down on the control stick.)
Down B - Refund (Tom crouches and holds his cash register overhead. If he is attacked in the state, the cash egister opens and sends a bag of bells flying in each direction. The stronger the attack, the heavier these bags will be, and the more damage they'll do. Similar to Marth's Counter.)
Final Smash - Bell Rain (Tom Nook summons a giant storm of bell bags to rain upon the stage, damaging anything they hit.)
