Ok, so that trademark leak is actually pretty huge when you consider a few things.

Let's be clear on why the leak is trustworthy and valid in the first place. It was released a month or so before x/y came out, and none of the "Mega's" it listed had been revealed officially yet. Now, of the names it gave, every single one of them got mega evolutions, except for Sceptile, Plusle, Minun, Rayquaza and Jynx. And it was comprehensive too, meaning no Pokemon not listed there got a mega after it was released, that we know of, with the exception of Alakazam, who is completely unregistered (meaning Nintendo was either never able or never cared to trademark it, the former being the obvious truth). So these guys nailed the assumption that these trademark filings meant mega-evolution on the head. And the fact the four Gen 3s out of the five thus not revealed, remain not to have one, and fact that Hoenn was confirmed. Fweh-fweh-fweh. Hoenn remake was in the plans for some time. How long though? Let's :050: Diglet-Dig a little and find out.

Japanese trademark, like American, is good for exactly 10 years. If you look at the 'details by generation' in the leak, it tells us that Sceptile's trademark expires on Aug 22, 2023. This means obviously that it was on Aug 22, 2013 that the trademark was accepted. However, the filing process takes a minimum of a year and a half to two years and a half in Japan! But ok, we have to consider this too: Most of these pokemon were already trademarked, which means much of this was likely trademark renewals. Renewals must be done no later than six months after the expiration date to avoid losing the trademark, and will as far as I understand, take effect immediately upon payment-received.

So what does this all mean? It means either that Sceptile was originally registered between Feb 22, 2003 and Aug 22, 2003, and was then renewed on Aug 22, 2013, --OR-- that he was originally registered between Aug 22, 2000 and Aug 22, 2001, and that it was then allowed to pass it's 10 year 6 month limit between Feb 22, 2011 and Feb 22, 2012 , where it was reapplied-for over a 1.5-2.5 year wait to finally be accepted again by Aug 22, 2013.

The vast majority of the Gen 3 pokemon were registered on May 9, 2003, with the earliest one we can be positive about being Illumise, registered on Nov 15, 2002.
So it would appear that without question, the Feb 22, 2013 - August 22, 2013 range is when they actually decided to renew Sceptile (Groovyle's date is the exact same for what it is worth, neither of them sharing an expiration date with any of the other Gen 3 starter families)

Now, there is one last thing to sort out here. It doesn't seem characteristic of them to purposefully pass the 10 year mark to renew, as there is an extra fee charged for renewing in that 6 month period after the 10 years are up. However, it's also not uncharacteristic at all for them to allow many of their trademarks on their pokemon to simply expire. Quite of few of them from Gen 3 have just recently been allowed to expire just from what I looked at, and it obviously tends to be pokemon they have zero plans of promoting or merchandising in the future. So what I believe we can take from that, is that considering Megas weren't even announced until around early Aug 2013, It's possible that pokemon such as Sceptile that were up for expiration during this critical range of early to mid 2013, may have been allowed to pass 10 years, because they were still planning and didn't know yet who they would choose, but then even if chosen after 10 years and before 10 / 6 months, were allowed to go all the way to 10 years 6 month since they were paying the surcharge anyway and doing it at the last moment gives them the most time on the trademark for their buck given the circumstances. So yes, I submit that the decision making period for finalizing and formalizing the Hoenn remakes fell roughly between Feb and Aug of 2013. Now considering Sakurai reportedly stated at E3 in June, that he was "thinking about it", on the question of Mewtwo's return, it seems the final OR/AS decision very, very potentially, if not most likely, was made before Sakurai finalized the roster, giving plenty of time to work in another character. It should just be obvious, that a game that was just announced a few days ago to be released in 6 months, would have been initiated around a year ago, give or take. But some some people need serious convincing. Also, I was kind of bored.

We got A tree stater in Brawl! Squirtle, Ivysaur and Charizard. Charizard still in but now alone, Greninja out nowhere apears, we got two stater of different type soo, where Sceptile???
Snivy, Chespin and Chikorita there confirm as pokeballs, Torterra my second favorate pokemon of all time don't fit well.
Venasuar looks a little heavy. Sceptile could be the one GRASS Stater we missing out and even HOEN IS REMAKE IS CONFIRMED, (There rumors about they have screenshots.)
Seriusly we need a grass stater pokemon.

Guys, please, stop with this argument. It's not valid.

You say that we have not seen any content of Donkey Kong Tropical Freeze, but, how many DK stages they have revealed? Jungle Japes for 3DS. Are they hidding it for a possible Dixie reveal? Who knows. You say that we have not seen any content of Super Mario 3D World, but, what do you want? Cat suit? Double Cherry? Almost every thing that is possible for Mario was already revealed.
Other important thing, Mario 3D Worlds was launched in November 2013. Sonic Lost World was launched only one month before and we have content of this game in SSB4. What, had not you seen? The Windy Hill stage already revealed is from this game. And it's a third part stage....
Wait... October 2013... Was not the month that Pokémon XY was launched? Yes, it did. Have you played this game? If yes, you know all the hints stated about Hoen. A NPC discribed Hoen and said that you are going to know this land soon. I'm pretty sure that a pokémon developer did not wake up this week and said to the other:
-Hey dude, lets develop a Hoen remake?
-Oh, yes. When are you going to reveal?
-Tomorrow. I think that Ken can disign a Mega Groudon and a Mega Kyogre to the covers, so we can show it since we do not have any content!

I find it absurd that people seem to actually think Sakurai only finds out about game information when we do.

The REAL problem of Mewtwo in Smash is in Reality very very but very strong in the pokemon series Now we see him here being defeated by a jigglypuff in one shot and defeated by swordsman with no magic power, Hades and Ridley are other characters that in reality are very very very strong and weaken them don't feel right or more even, "Weird".

The Rest of Mewtwo is Complete ok and welcome.

I just recomend to keep your expectations realistic and low that way if Sceptile isn't in the game you will not be crushed that hard, and them blame Sakurai for not going the "logical" way. If he ends up being included then your surprise and joy would be higher, it's ok to dream but try not to find patterns that PROBABLY aren't even there.
Wise words. I think perhaps a lot of people fall into the trap of deciding on a character first, then only looking at or interpreting information in a way that 'supports' their inclusion.

Personally I think the most likely list of Pokemon reps is the characters we've already seen + Jigglypuff. Cutting a three-game SSB veteran would be outrageous, and two newcomers for what is already one of the best represented series in Smash would seem out of proportion to me. If that Pokken Fighters thing turns out to be true, though, I'd definitely be up for seeing Sceptile in that.

It's not your fault since you're new, but I constantly have to explain to people that Plusle and Minun were not planned for Brawl and that "pra_mai" couldn't have been them.
So whenever I see someone mention that they were planned for Brawl......my avatar happens.

Unfortunately, there is no real answer to the identity of pra_mai.
However, evidence points against it being Plusle and Minun.

In my personal opinion, I think were good on the amount of Pokemon characters, although Sceptile does seem like a possibility.

Hyped for the footage, but I'm not expecting Mega Sceptile to show up just yet. Starters getting Mega Evolutions is probably one of the most hype things Game Freak can present, and thus they gotta keep it close to themselves for as long as possible. Remember the Mega Kanto starters reveal? Happened a month before release. Since they've already blown the mascot Megas, the remaining starters will likely be kept at bay for yet some time. Not that I'm going to complain if I'm wrong of course, but don't end up dissapointed if we see nothing in regards to Mega starters, it's the most likely scenario after all.

Probably best if it's discussed in the Social thread. Unless it's Sceptile related... But like Wariofan, I'm not expecting them to reveal his Mega-Evolution in this....

Just going to put this out there...

Even if Sceptile gets a Mega Evolution, I don't think that will significantly increase his chances.

...But I'm willing to bet that if he does get one, there's going to be a lot of "SCEPTILE IS A SHOO IN!!1!"
