It is still a grey area and one of which I would rather side on caution. I get where you are arguing this but the case in point is to avoid the situation all together. Thanks for that, but I still see nothing that would indict smashboards
Section 1470 of Title 18, United States Code, prohibits any individual from knowingly transferring or attempting to transfer obscene matter using the U.S. mail or any means or facility of interstate or foreign commerce to a minor under 16 years of age. Convicted offenders face fines and imprisonment for up to 10 years.
Clearly the intent of SWF is to not do this, there's no way they could be blamed. Once again, if SWF could be blamed, so could every forum that has ever existed if you blame the service for what the users do. Since I have never heard of this happening and reddit exists...
There are also laws to protect children from obscene or harmful material on the Internet. For one, federal law prohibits the use of misleading domain names, words, or digital images on the Internet with intent to deceive a minor into viewing harmful or obscene material (See 18 U.S.C. §§ 2252B, 2252C).
Same as before, you have to prove intent. If SWF is complicit in minors finding porn, the google.com is the worst offender ever
It is illegal for an individual to knowingly use interactive computer services to display obscenity in a manner that makes it available to a minor less than 18 years of age (See 47 U.S.C. § 223(d) –Communications Decency Act of 1996, as amended by the PROTECT Act of 2003).
If anything, this would be the users fault, and then Skypes. SWF would be no where near getting blamed.
It is also illegal to knowingly make a commercial communication via the Internet that includes obscenity and is available to any minor less than 17 years of age (See 47 U.S.C. § 231 –Child Online Protection Act of 1998).
Same as before.
Of course I'm no expert on this stuff, but I really... REALLY hate it when people justify their actions because reasons. I'd love to see a website in the history of the internet getting in trouble because a user posted a link to a site that may or may not host porn.
What if someone on this forum mentions an art website, is that banworthy too because of reasons? We all know what you'll find on any popular art website.
Even other places that allow it instant ban you if you post it without a NWS tag for the topic.
Some of the people who have told me I trust it to be true. The ones who have said theres porn in our chat are not even in our chat in the first place and word of mouth is a very weak thing when it comes to this sort of situation.
Not to mention this was a problem in the first place when I removed the link in the first one and Kami kicked me for that.
I talked to you about this before.Pretty sure this restarted when mti got upset over the lack of strict rules and left to make his own group
You know exactly what I am talking about.
The arbitrary/ban kicking for dumb reasons and threatening to kick if they are a part of the other chat.
