For the record, I get the gist of what the issue is that people are bringing up, but it's being explained too vaguely to make it clear enough. Right now, Toad is not playable. There's no reason to believe he's be based off of Mario's gameplay. So the idea of him being a "clone" doesn't make much sense. Thus, there's no reason to try and de-clone him. The moveset, which is actually pretty imaginative, is basically just being unique. So far, I'm not reading why it being unique is a bad thing. IMO, I think it barely resembling Toad is the issue, but I couldn't see a single post that is making that clear(maybe that's not anyone's argument to begin with? But if is, it's not being made clear in any way. Think of how easy it it for another user to understand the points you're making. Try to explain them thoroughly without dismissing their fun ideas as well. I am seeing a lot more dismissal than properly explaining the flaw too. How is that going to convince another user to go for a different idea? It won't.)
I think for my part at least, the issue isn't the uniqueness, but it's that it's seemingly just a work around to get anime series moves into Smash on a character that doesn't really relate to it.
Same reason I'm not keen on the suggestion of Waluigi bringing forth a stand. Lucario is there for your almost Dragonball abilities, and Joker kind of has a stand anyway, and those moves suit the characters far better than Toad or Waluigi.
Although if you must give Waluigi a stand at all, I'd suggest rather than punching it serves a flurry of tennis balls.
Or at the very least if you're going to give Toad ki attacks...please explain why!
For example Fox's specials are based off his Arwing's abilities, or Falcon is based (very, VERY) loosely around the F-Zero racing concept. I just don't know what energy blasts say about Toad as a character!
I'm all up for distinct movesets but I feel they need to say something about the character or reference something about the characters history at least.

Ironically the only time I think the only Mario game that really relates to other games in any canonical sense is actually Captain Toad Treasure Tracker...it's set up as a direct prequel to 3D World/Odyssey and the Super Crown from New Super Mario Bros. U Deluxe seems to be an ancient treasure Toadette in particular searched out, hence her being the one who uses it in NSMBUD.
Speaking of, one neat little thing I like in the DLC was the illustrations depicting that canon hunt;
As you can see in the artwork; Toadette is the one of the duo who finds the ancient map describing the legendary crown, and whilst Captain Toad is happy with the heaps of crowns he finds, Toadette isn't as easily impressed...she WANTS that magic crown. Even in the last image she's examining the one they got from Wingo.
Lastly after you beat the final maze, Toadette is standing BY the super crown ready to collect it. I think these are neat little additions.
