Now that this has calmed down, (I didn't even come to here to argue, just to have a good time. That really wasn't fun.) maybe now I can post that picture I was intending on posting.

I believe so, I forget the exact details of it though.
EDIT: It was a patch that prevented users from using a different operating system on the console. You could decline the patch at some pretty severe penalties, but it wouldn't brick the console like the Nintendo EULA is doing.

  1. In proprietary software, an end-user license agreement (EULA) or software license agreement is the contract between the licensor and purchaser, establishing the purchaser's right to use the software.

End User License Agreement. It's basically all the terms and conditions you get when your installing new software or other such applications.

Well, it leads to a larger question that has been going on for years about how much control a software creator should have after the initial purchase of product or software. Made worse as the gaming industry has had a bad tenacity to misuse such methods in rather misguided ways in the past.

I can understand maybe disabling some features such as Miiverse or online, but completely disabling the console until they agree? Not so much.

Heck, if you want an example, look at Shadow of Mordor. There was a company that sent out codes to video-makers to "review", the downside being that they were bound by a contract and essentially controlled. They had to speak about one topic for so long, they had to constantly preach that you should get the game, and God forbid you say anything bad about it (or find a glitch, or make a mention to Lord of the Rings or The Hobbit for that matter).

The game industry already has a pretty poor standard on what the EULA are suppose to be used for. The thing is as much as most of us don't like EULA, they are a necessary part of life and they don't do harm when they are used correctly, particularly with online services that define how and under what restrictions a software could be used.

However, many companies are now using EULA to dictate terms for their benefit at the expense of those that are actually using the software. Worse is when they attempt to take certain legal rights from consumers by including language that removes certain legal ramification from users by agreeing to the terms. It's a major problem and a huge issue with how they are being used in the modern era, so it is definitely a major problem... especially when no choice is given.
