Again, he didn't say anything about the character not being able to appear, he was talking about playable characters in general.If I character can't appear because of liscensing issues, it's not showing up at all... I figured that was generally known.

A similar situation happened with Cartoon Network Punch Time Explosion. In the original 3DS release, Johnny Bravo was an Assist character because of a liscensing issue in regards of him being playable. While he was unavailable to be playable, he still got in the game somehow. In the updated re-release for Wii, 360, and PS3, Cartoon Network Punch Time Explosion XL, the issues have been cleared and Johnny Bravo became playable.
Now remember that Starfy is a 2nd Party character partially owned by TOSE. He is still a Nintendo character, but negotiations with TOSE have to be done. And since there are signs that Starfy was initially planned as a character, it is very likely he was a case like Johnny Bravo; denied as a character, but allowed as an Assist.
Your findings mean nothing as it's nothing more but crackpot theory as you said.
Likewise, I have a crackpot theory about Dr. Mario being included in Brawl right after Mewtwo and Roy that, while just as asinine as your Geno theory, seems more reasonable and less straw-grasping.
I'm sure you don't care, so I won't bother sharing it.
