I think they just pay for Nintendo Online in general.

I notice playing as or against some characters online is harder due to the lag. Like, I feel like I can barely play as Mewtwo online due to his floaty jumps. Trying to Dash Dance with Mewtwo professionally online is harder due to the lag. Certain other characters too. But I can totally believe online has a separate tier list or meta from offline as it's like playing two different games competitively. I certainly would love to get into local tournaments instead of playing online if COVID wasn't a thing. It sucks because online I can never play at my best.

And yet probably the only way Nintendo would even attempt to fix it is if some sort of legal action forced them too.

And they would win the lawsuit like how they always win with the Joycon Drift ones.

Why would anyone even try to sue Nintendo though? There’s nothing illegal about having slightly laggy servers. That would just be a huge waste of time and money
