What if Nintendo doesn't approve?

Am i the only person who is worried that Nintendo will go ape **** over project m sooner or later? Because correct me if i am wrong but didn't Nintendo try to shut down brawl in the family? what is stopping them from shutting down project m? is it because it's making people play SSBB more or is it because they have no clue about project m yet?

They almost certainly don't "approve", but I'm pretty sure they know about it by now and if they were going to C&D then they would have done it a long time ago. That's how I see it anyway.

I would assume a big company like nintendo would have to know about Project M. But I think like you said, the fact that it may be causing more people to play SSBB more might have something to do with it. Also PM isn't making money off this which is probably the biggest factor.

Wow i didn't know this lawsuit even happened... oh yeah 92.. ****.

Still, at least to me, Project M stole all my hype for SSB4. and I just have this bad feeling that this could piss them off. do the C&D anyway.

Nintendo has no case against a non-profit mod for their game that is done in an entirely legal way, especially since they have had years to stop it (1.0 came out about 3 years ago).

Nintendo also hasn't stopped the entire Brawl Vault, Brawl Plus, Brawl Minus, Balanced Brawl, etc., even though they could.

Truth be told, mods add value to Nintendo's games, just as they add value to Valve's games (heck, Team Fortress, Deathmatch, and Counter-Strike were originally fan-made mods).

Even if Nintendo didn't approve, it's not like they can stop people from playing or holding tournaments of Project M. The PMBR just can't release another update.

This argument and debate is about 6 years past relevant.

If Nintendo wanted to stop Brawl modding, they would have done it already.

It's time for everyone to wise up and move on.

This is probably our best defense:
http://en.wikipedia.org/wiki/Lewis_Galoob_Toys,_Inc._v._Nintendo_of_America,_Inc.
It's even better for us because PM is non-profit.
Glad someone else remembered this.

Even if Nintendo were to file a C&D, Project M actually has the advantage from a legal standpoint as it is unable to exist on its own, meaning it is not technically considered a derivative work.

Either way I'm hopeful that Nintendo has learned from its past mistakes with the Game Genie lawsuit. Though to be fair, if Nintendo did decide to take legal action, I doubt anyone in the PMBR would actually be willing to take Nintendo to court over it. They'd probably just shut everything down and play it safe.

Not for Profit doesn't necessarily mean that they won't C&D it. Hasbro C&D'd the MLP Fighting game, Fighting is Magic, so who knows what's gonna happen in the future.

That is a derivative work, however. Its only the use of their characters, rather than a modification of something they sell. Clearly the project is able to exist on its own, since the project resumed once they replaced the copyrighted characters with their own creations.

True enough, it's still a shame that the original product got C&D'd. I was really looking forward to that. Oh well.

Then they won't approve.. there's nothing more to it. Hopefully you guys will back us up and do something about it. Via petition blah blah blah. Whatever it is. Make the community look strong.

Well the only P:M specific shirt so far only features the new P:M logo, to which Nintendo doesn't own any sort of rights afaik. I'm guessing that this is why they've changed the logo to begin with.

I'm more concerned about the other shirts, like the ones with a Smashball or the ones with characters that have been sold since the EVO campaign. How does this work out exactly ? Because I don't think there's been any reaction from NoA yet.

You guys make it sound like that Nintendo really does not care for the smash community.
Did i miss something?

But anyway from what i read everyone is saying that nintendo doesn't really care as long as we don't make money on it?

also i think people already sell video game meme shirts , i don't see how project m shirts would be any different.

Smash is a series where Nintendo characters beat on other Nintendo characters. Nintendo is really standoffish as a whole regarding the series, though some in it seem to love it, others don't really wanna give it the attention it deserves, which is why you don't really get the series advertised as heavily as other Nintendo series.

Has Nintendo ever approved of the smash community?
Nintendo never approved of any real fanbase other than the idiot fanboy drones who praise whatever they do/say and the "casual" market, most of whom suffer from some sort of mental affliction.

However, to be fair to them, at least they haven't disapproved of us and actively gone against us like say Square Enix has done in the past.

Well, at least other than the MLG Melee and Brawl shenanigans and the crap at EVO 2013, but we let them get destroyed by the PR machine and video game media for the last one because they deserved it. ;)

Hopefully they learned to "back off" forever from that in regards to stuff like Brawl modding.

To be honest, Project M and Brawl Minus are the only reason I kept my Wii and bought games after Brawl. In that way, Nintendo made quite a bit of money.

Well, some guy got banned on Miiverse for talking about PM, but I do not believe Nintendo has any ability to issue a C&D on PM because they're within their rights.

They have every right to C&D us at any time because we are using their materials from my understanding.

Ordered a C&D for a Radical Dreamer fan English/multi-language translation after Square said they wouldn't release it internationally.

Radical Dreamer is a part of the Chrono series along with Chrono Trigger and Chrono Cross btw.
I did some research, and it seems to be the fan game that was C&Ded, not the translation pack.

Except when they do, like they did with Melee at MLG, Brawl at MLG, and Melee at EVO 2013.
Ive left bees alone plenty of times and ive still been stung, i guess they dont realize that stinging others usually hurts themselves more than it hurts the ones who they stung

Well maybe if Nintendo didn't realize their stingers hurt themselves the Wii U would actually be selling.

No matter how much of a **** Nintendo gives, if they wanted to or even could have done something, they've had 4 years to do it. Pretty sure they're nothing to worry about.

Pretty much. You'd think they would have done something about Balanced Brawl, Brawl Minus, Brawl Plus and Melee SD Remix before they even considered Project: M. Since they haven't even gone against those projects, odds are nothing will come of this.

Except that PM actually benefits them because that can influence people to buy Brawl. Also, we technically own the materials upon buying Brawl.

I don't think buying the game means you own the hours of work they spent modeling and animating.

Like with source film maker, you get all the materials of Team fortress 2, but you can't make money off of it unless you made every model and map from scratch.
