3.How is Project M any different from any other set of hack cheats? With enough codes, ANY game could be made into a "new experience". As far as the law is concerned, is there any difference between making a character invincible and giving the shine a jump cancel?

In the post I was responding to, you wrote that the judge said that "modding a video game for one's enjoyment" would be like skipping sections of a book, and I was trying to specify that the judge was talking about the use of cheat codes such as invincibility or infinite lives, and not modding in general.
3. Hmm... You have some good points.
-Originally, I saw a fundamental difference between the Game Genie (which generally serves to make the game easier and doesn't create brand new user-created content) and something like the user-created levels in Duke Nukem 3D or Project M (which add brand new content to the game that was not created by the original developers).
-After doing some additional research, it seems like you might be right. I don't know much about coding, but it sounds like the PMBR is basically altering the coding of Brawl in the same way that Game Genie users alter the coding of a game, just on a much larger scale. (If this is incorrect, someone please correct me. I don't really know how the PMBR works their magic.)
4. I was pretty much just referring to the Duke Nukem 3D case. I should've specified in my original post.
I should add that there is obviously a major difference between the Duke Nukem 3D issue and Project M. As you said in your post, the Duke Nukem levels were being sold for a profit (which PM doesn't do) and the modified work took the physical form of a CD (which PM doesn't do either; it's not like the PMBR is selling SD cards with the PM codes already on them or anything like that).
After giving some more thought to all of this, I think that it is more likely that Nintendo would not send a C&D as long as no one is profiting from the mod.
Having said that, I still think that we should be cautiously optimistic and avoid doing anything stupid that might attract negative attention from Nintendo. Regardless of whether or not Nintendo has any legal right to shut down PM, if a C&D were sent, it would almost certainly be the end of our game. Why take that risk? There is nothing to gain from associating Project M with anything anti-Nintendo or anti-Smash4. Let's please try to stay on Nintendo's good side. They are the ones with the power in this situation, regardless of our opinions of them.
