Personally I think that anything can get in, look at Snake/Cloud for example. If they can get in I can safely assume that the "bar" for character inclusions is set to 17+

Personally I wouldn't mind Jinbe, he has decent moveset potential(and he's a main character now after Whole Cake Arc, so I guess that would help? Idk?)

If a One Piece character appeared, it'd be Luffy, but no characters that didn't originate from games would appear in Smash (rights nightmare too)

Joker is from Persona 5, which is a video game. The manga and anime are based on the game. Fire Emblem characters are also still video game characters, so that point still stands.

I hope it stays this way too, otherwise non-Nintendo characters will end up being from manga, anime, cartoons, movies, and comics..we do not want the flood gates that opened..
