Poppy seeded bagel cause mom to fail drug test. Gets kid taken away from her.

A New Castle woman said her child was taken away from her after the results of a drug test came back wrong.

The woman said she tested positive for drugs after delivering her child because she ate a poppy seed bagel before giving birth.

Elizabeth Mort said Children and Youth Services came to her home three days after the child was born at Jameson Hospital to remove the baby from her home. CYS officials said her hospital bloodwork showed that she was using opiates.

According to the Pittsburgh American Civil Liberties Union, the bagel's poppy seeds provided the false positive.

Sara Rose of the ACLU said CYS may have violated the law.

"One thing I think is a violation is the fact that Lawrence County CYS immediately got a court order without the parents present to remove a newborn baby based solely on the hospital's report of a positive drug test," said Rose.

Jameson Hospital released a statement to Channel 11 News saying that they were only following the law.

A Pennsylvania House Bill 2760 that passed three years ago allows hospitals to test a mother's blood to protect newborns. But the ACLU said Jameson hospital went too far and failed to consider what Mort might have eaten.

The ACLU is representing Mort. Rose said they are working toward filing a civil rights lawsuit on her behalf. The child has been returned to Mort.

Jameson Hospital released a statement saying, "We have initiated an investigation to compare our standards to other community and regional hospitals. And if necessary, we will advise our reference lab to critique their standards for consistency."

I would say something about how this is another example on why we should stop the war on drugs. But that's too easy and obvious so I'm just gonna link to the Seinfeld theme cause this story is similar to what happened to Elaine.

They should know the difference in the levels of opium. If you use listerine (which has alcohol in it) and blow into one of those machines that test the alcohol level in your breath so you can drive it wont fail you. So why would a drug test fail you if you had TRACE ammounts of opium?

I've seen this happen like ages ago on a 'science' program called Braniac. The test subject did literally get really seedy bagels and got the test the next day though.

If you watch the video in the link, the ACLU spokesperson mentions that the level of opiates in her system would not have been considered positive under federal government guidelines. It looks like the hospital uses its own guidelines, and that's something they can be held accountable for.

This. I watched that show too and they got a Priest to eat bagels then made him do a drugs test a lo behold it came back positive.

There was a report of the icecream Bubble-O-Bill effecting alcohol readings

Did anybody consider the fact that maybe she ate the bagel to cover up her drug addiction?
I believe the opiate concentration was too low to be anything more than Poppy seeds.

Well its good to see that the mother has her child back. I'm also glad there's a lawsuit, mistakes like the one that Jameson hospital made(and CYS) should not be tolerated, since they both seem to be at fault.

Probably just a false positive from an unreliable testing method. I've heard that the whole poppy seed thing is very unlikely.

Either way, it's silly to ruin someone's life on an intrusive suspicion that they may have a socially unwelcome habit.
