Oh, I know that. It was a rhetorical question, since quite a lot of complainers here will say things like: "Now we'll never play with FSes competitively." But really, this is no different than items, provided we have the option. Don't want it? Turn it off and forget about it.
And y'know, even if you were to play a match with that on for whatever reason, not every FS is something you can simply activate the very second you respawn. Link's and Ike's, for instance. If you're playing a Peach and you're afraid of something like that, just make sure you're in the air when it's launched, and try your best to smack around Peach while you're falling. And if they decide to save their FS for a later time? Well, once their invincibility wears off you've got a chance to steal their Smash Ball and render all the Pity its appearance ever had meaningless.
Not that I'm saying the Pity FS is a good idea--it's not, and it's certainly unhealthy for a competitive environment. But there are ways around it if we can't turn it off (yes, I know, we can always turn Smash Balls off but you get what I'm saying).
