They were ruled out of Melee (as PLAYABLE characters) for _____ reason, this reason is constant, so it will still be there when it's time to form the Brawl roster, thus the same outcome is likely to occur again. That is being objective.
On the other hand, you are pulling out this unprovable rule that since this is a new game, those reasons before some how are going to be disregarded, I don't see where you can get that interpretation (but if you have one that can apply please tell me), so it's obviously guided by subjective thoughts.
