My brother Stephen has been dating this girl Carmella for a little more then 3 years. Right now Carmella is 16 and my brother is 17. My brother is turning 18 in a week and a half, but he (and she) still want to be sexually together. It's kind of a touchy subject to talk about in person, and I'm a bit nervous to talk to him in case I say the wrong thing... any advice you guys could offer?

I think he was wondering if it would be illegal for them to have sex or something because one was a minor and the other is an adult.

Tell him: Get someone who isn't named "Carmella".

If both parents are cool with them being "together" then I don't really see a problem. As long as he doesn't **** her or they have a bad break-up where she could claim something ludacris like that, then he is safe.

Ok, seriously, just make sure neither of the two have STDs and have not had sex in the last 6 months (an STD test shows wheather or not you had an STD 6 months ago). As long as they're both clean, tell him happy humping!

On the legal issue it really depends on where you live. Look it up based on your state, country, or province. I think where I live it would be legal, some places allow a 4 year age difference if both are over like 15, and some places a 16 year old is technically legal but if they person is like 55 they could get in trouble, but at that age difference they rarely pursue it unless someones parents have a problem with it.

*Edit* I look up the weirdest things sometimes. I need to stop going to wikipedia when I'm bored.

There are VERY few states the law is 16. However, some states of exemption clauses. If yours has neither, he can be facing some serious felony charges if a. he's caught in the act, b. her parents get suspicious, c. she gets pregnant, and d. they break up and she reports him. If they are dating for 3 years, I am sure they have discussed it, so why worry.

He is getting involved because he is looking out for his brother. He doesn't want to see his brother go to jail over something he could have helped him with, as I'm sure you wouldn't want any of your family to go to jail either.

Does anyone find the implication that they have already in engaged in sexual relations while both were underage being presumed as OK, but now, with one turning legal age, it has suddenly become a very serious matter and illegal as amusing?

It was illegal before your brother turned 18, doesn't make any difference.

Besides, didn't some 'sex offender' just get released because it was deemed the minimum punishment was a bit steep for what was consenting sex? I can't remember it exactly but it is something along those lines.

No, depending on the state, the punishments vary. At the very least, he'll have to register as a sex offender.

I am starting to think this is all a joke thread. If he knows his brother has had sex, why is it suddenly hard to talk about it to him?

I'll give this another day for Unsung to reply otherwise, **** that.

Usually I would discourage placing your nose into this situation, however, since the miss is only 16(which may be illegal), she probably is still in high school. I'd say they should meet
1. Their education goals.
2. Their profession.
3. Proper housing/conditions for an infant.

Just tell your brother girls are ickey and have koodies. (Ugh koodies. :urg:)

Sorry for delay. What exactly I'm wondering is advice that I can give to help my bro or the rules between a relationship between someone that's 18 or over and a minor, and the state laws between them. I live in FL, and I've been looking online but have been confused on exactly where to look for a list or whatever. I'm not trying to be snooping around, but as a brother I'm confused and was hoping that out of all the users here at least one would know some advice or regulations on being in a intimate relationship with a minor in so-or-so area. They're close, and as corny as it sounds, I'd be really sad for him if this broke them up and I couldn't help in some way...

In Florida it is 18 between an male and a female. Meaning, yes, any sexual (ANY) interaction is grounds for felony. But the question comes back, why get involved? As Cain once said, you are not your brother's keeper.

I'll check this one site I found to see if Florida has an exemption clause (like Louisiana) but I doubt it.

Most noticeable is section 794.05 part 3.

Under 16 seems to be the age they use, so he may be in the clear. Just hope her parents are cool because if they call the DA, then issues arise whether they did stuff or not.

I don't know how it's over there in the US , but over here it's illegal when:
- 1 is underaged (under 18)
- there is a difference greater than 3 years between them.

So there isn't anything to worry about if it's the same rule system.

It's not the same.

Some states have an exemption system of 4 years, some 6 months, and some none at all.

I have been in a situation where my girlfriend's mom threatened legal action, even if we did nothing at all. I made **** sure to know the law in great detail with all this.
