If you say characters that have a spirit in the game can't be playable... what's left that Nintendo thinks people would pay 5-6 bucks for, and that they also have control over, in this case?
It feels like a short list, and not the best list either. They're limiting their options for Nintendo properties if that was a concern... not picking from the spirits. It certainly opens the door for some of the wilder third party dreams, but given the circumstance of selection, that also just feels weird. Then again, those are the kinds of characters that would sell perhaps the best. 3rd party characters that are the leads of popular franchises not necessarily associated with Nintendo that bring the fans of these games into Smash. Even so, I'm still thinking we're getting some 1st/2nd party characters in the DLC, at least 2/5. And I wouldn't be surprised if a couple of the DLC characters currently have spirits.
Also, a while back I tossed out a "workaround" for the whole Rex spirit and Pyra spirit thing (now Mythra too). The playable fighter would be "Rex & Aegis" essentially (could also work as "Rex & Pyra" though that kinda assumes no Mythra). In any case, each spirit is just one half of a team that makes a single playable character. It's like if there were a Nana spirit or a Luma spirit. I haven't looked at the datamined list and admittedly I doubt those spirits are there... but if you're really hung up on spirits, this is a "cute workaround", lol. But maybe that's just being optimistic in the face of the potential that spirits could be a deconfirm... though, honestly I haven't seen anything change that would make me think spirits are a deconfirm all of a sudden when a couple days ago they weren't when we already knew that Rex and Pyra had spirits anyways. DLC, as stated by Sakurai, was a separate consideration from the main game. What we see in the main game does not account for the 5 DLC characters that are in the works now. Not saying to be more optimistic... just saying that I don't think anything has really changed at all over the last couple days for us and our chances of getting what we want.
