The catch is that anyone with a enough time can learn there MU's accordingly while furthering the metagame. its just P:M comes out with new versions so people would rather take the easy way out. it happens in many games, and nothing is wrong with that

I'm not sure people making comments in her know what as CaD is when they are making comments like it would do nothing or that they have no grounds.

The game definitely is using something copyrighted there is no dancing around that.

Saying it would do nothing is ludicrous since other gaming companies have tried and succeeded in shutting down projects. Valve allowing mod? A lot of it is freelance and some very poorly made mods some of which you even have to buy from valve. Good ones yes and PM is a well made mod, It isn't endorsed by nintendo, that still remains.

That said I can see why they aren't as open to modding and Valve is rare in itself to do such with mixed reactions and results.

If people still want to host tournaments they can, but it's never gonna hit mainstream like EVO or anything.

Fair use is a gray area, but there are certainly arguments to be made in PM's favor. The Game Genie case where Nintendo lost in particular comes to mind, but precedent doesn't mean THAT much in terms of fair use as I'm pretty sure fair use is mostly done on a case by case basis.
But to actually make that argument involves going to court... and that's basically what makes a C&D order successful in cases like this. It doesn't matter if PM is legal or not if you can't afford to go to court and fight for it.

But still, does Nintendo want bad publicity? Issuing a C&D for PM would cause a **** storm considering how much not just PM but Smash in general has grown as of late, and it would be idiotic to assume Nintendo lawyers don't know fair use laws inside and out so even they can recognize that there is a legit case to be made in PM's favor. It's probably just in Nintendo's best interest to not acknowledge PM officially and leave it be.

On this same vein, I don't understand why people are getting SO MAD at Nintendo.

C&D aside, Nintendo wants to support the smash tourney scene but cannot sponsor a tournament with PM in it.
Its not like Nintendo is choosing to destroy PM in anyway they can. These are just the facts. Turning a blind eye to the PM scene is a totally different thing than supporting a tournament with PM in it. The legal ramifications for Nintendo in that case would be dire.

Sure, Nintendo is only supporting the community again because there is something in it for them, but can you really blame them?

Nintendo sponsoring smash events is good for every other scene except for PM. That is why there is so much tension between people right now.

"BURN NINTENDO THEY ARE GOING TO DESTROY PM WITH THEIR GREEDY WAYS" is not the whole story here, and people on both sides of the debate need to step back and re-evaluate.

I love using Toon Link, that character is amazing for counter picks. I counter pick him with Pikachu, MK, Roy, Ness, and if he is an aggressive Toon Link I counter pick him with Ganon. I use Toon Link against very defensive players, and I use him to counter pick against Sonic, Squirtle, Pikachu, Defensive Lucas, Olimar, Peach, Jiggs, Wario, Link, Charizard, Bowser, Ivysaur, and Yoshi.

I cant play wolf for **** lmao, if I play as him I just nair into double shine, that's pretty much it haha. When fighting a wolf I counter pick him with Marth, Pikachu, Lucas, DK, Roy, Toon Link, Samus, Yoshi, GnW, and Zelda.

I use Ike occasionally, I pretty much use him against players who I think won't be able to handle my speed. Luckily Pikachu straight bodies Ike, so I usually don't have to counter pick him. And if I do end up having to counter pick I just go either Falco or Rob. I go Falco if I think that they are a brawl player, and Rob if they are a melee player.

If I ever play you that would be one epic mm, especially if it was a best of 7.

I don't even care for PM not being at Apex, and the C&D seems false so WE, I'm just annoyed we aren't getting an explanation or even an apology from Strife.

I'm mad about PM being cut, sure. But I'd much rather get a confrontational explanation rather then this passive stance taken.

Real talk, if PM got more people then Brawl/Sm4sh/64 (and it would) at a Ninty sponsored tournament, that'd look so bad at Ninty's part.
