Rare still contributed to Melee though. It was in development up until a year before the Buyout. They helped design Donkey Kong's game model and both Rare's Chris Seavor and Steve Malpass voiced the Star Fox characters. I actually think a bigger reason Diddy wasn't in Melee was because Nintendo was very respectful towards not using Diddy (even though they owned him). Rare staff has commented that Nintendo always felt Diddy was Rare's baby and that they never asked to use him (but would suggest for Rare to use him, which is how Wild Cartoon Kingdom became Diddy Kong Racing).I don't think Melee was quite his time yet. If Diddy was added in Melee, then yes, Brawl would have been the perfect time to add him.
If the Rare buyout hadn't taken place right around Melee's development, then this scenario could actually have happened.
It wasn't until Rare was sold that Nintendo set about incorporating Diddy more, which is probably the real reason Sakurai didn't consider him until Brawl. Unfortunately, that means the DK series has been playing catch up ever since.
