There are several threads on this subject already.

Informed opinions is that there is no reason to restrict their legality or movesets at all. Debate hinges on Mii size.

Yeah, kind of a dead subject at this point: Nothing special about Mii, just let people play the game without having to push rules on everything.

But I can't fathom why Mii size/weight would be an issue, competitors react to variances of damage %, random hitbox property, and Directional Influence at a moment's notice the entire game.
When someone goes up against a fat looking Mii I'm sure they'll be able to understand it as a "heavy" weight class and react to it differently than a "skinny" without even thinking about it. If that's a problem then they should probably either look into getting better or playing a different game that doesn't have weight factor.

I don't really see the weight issue is a problem. It's more so being able to pick your own mii over a guest mii. Since Miis on anybody's wii u require either a 3ds transfer or a moment in the mii maker. choosing a guest mii is the most logical way of making the character usable which takes the weight issue right out of the equation.

As for moveset restrictions, they should have none.

I personally think that it should depend on whether or not custom moves are allowed or not allowed.
