transfer 360 arcade game dilema

Hey guys, I am in a bit of a pickle here. Me and my little brother share the same xbox with the same hard drive, so half of the arcade purchases are mine and some are his. Now, I just ordered my own 360, and I want to be transferring all my own games and my gamertag to that new harddrive that will come with my 360. I know I can recover my gamertag to the new console via xbox live, but how do I go about downloading the games. The last time I tried to re-download my titles to my friends 360 after recovering my gamertag but it wanted me to purchase the games again even though my tag already paid for that title before. I've looked on google and they keep telling me to just re-download the titles no charge.

Also I heard that midway went bankrupt, and nobody will be able to purchase Ultimate mortal kombat 3. Okay, so how will it be possible to get that game from one hard drive to another?

You have to transfer your game licenses via the xbox.com website and then on your new 360, go to your download history and re-download everything.

And you are still able to re-download the Midway games if you've purchased them previously, I believe.
