Legality Question.

Hello, I am Phloat, and I have been wandering around the pool room for a while, and found the people here very smart, and savvy of the internet and its laws. I came across this recently -> www.allsp.com <- and was wondering exactly how legal it was. I saw the disclaimer, and all I got from this was that they are free from legal problems themselves, but nothing about the viewer itself.

So, is it legal for the viewer?

If the videos that the site links to are copyrighted and the copyright owner has decided not to allow it to be published on the internet, then it is illegal for anyone to host them without permission and it is illegal for anybody to view them.

So in this case, the viewer's actions would be illegal if the South Park videos were illegally hosted.

Comedy Central apparently has all South Park episodes available for viewing (http://southpark.comedycentral.com/season.jhtml?season=1). And based on the terms and conditions of Comedy Central's site (a link way at the bottom), it is illegal for anyone else to download or host the videos.


In other words, it's illegal to download, host, or view the episodes from any site except Comedy Central's.

Well, thanks a million, I really ignored laws until recently, now I'm on the right track..

As long as the owner of the products in the video are given credit, than yes, it is perfectly legal. However, if no credit was given, the owners of things used on the site could sue for copyright infrigement
Not necessarily...I didn't see the websites (hey, I'm not a SP fan), but from what GS said, COmedy Central specifically said that no one can host those videos...they have the copyright, and therefore, it would be illegal, even if you give them credit...

I was always under the impression that the creators didn't care. They just want views.

That's probably true but unfortunately, in today's litigious world, all that matters really is what the law says, even if the specific creators think otherwise.

Agreed, but at the same time, don't the creators have Comedy Central in the palm of their hand?

I mean, they get away with so much. And they always win those battles.

Matt Stone and Trey Parker basically own Comedy Central at this point. When Chappelle left, they lost any chance at being so well known, so South Park came through and add that Matt and Trey don't plan to strike any time soon, Comedy Central owes them a lot.

But, CC owns the show now, so it's up to them what is allowed or not.

Regardless of whether or not it is illegal for them to host those files, it is certainly not illegal for you to view them.

It definitely is illegal, just like it's illegal to to own and play "bootlegged" games or listen to such music.

That doesn't mean you can get caught, though. There's really no way for anyone to find out you've been watching episodes.

I do it all the time, and download music too!

That is pretty much how the piracy law work. You cannot reproduce, sell, view, or buy copyrighted material without consent.

Yeah, same here...but I didn't know it was illegal until just recently :laugh:...but yeah, it's illegal nontheless...it's just one of those laws that can't really be enforced...there's no easy way to catch people viewing/listening to bootlegged media...
