Did I just stumble across some music theft?

So I heard this song 'Own this club' on the radio today and noticed it sounded remarkably similar to '(Tonight) I'm loving you.

First listen to the first, far more famous original tune

If Men at work can be sued and lose for having 3 seconds of 'Down Under' that was very similar to 'Kookaburra sits in the old gumtree' 28 years after the fact, I'd say there's a legit claim to copyright violation.

It sounds similar but it is subtly different, honestly I'm so sick of this whole theft idea.

Its one thing to become popular by using auto-tune to cover your lack of singing ability
its worse when you add the fact that they are singing about 'the club', which has been done in 100 different songs this year already
and then they cant even come up with an original tune.

no respect at all for that

It doesn't sound subtly different, it sounds subtly the same, at best. This isn't music theft. First, they're not even the same, they just sound mildly similar. Different rhythm, more BPS, different inflections, the only point you'd have a case with is the very beginning portion of the chorus, and even that's weak.

If you want an example of blatantly stealing music, check Bearforce 1 out.

You might want to minimize it and just listen. Even THIS isn't considered music theft, but a tribute. 80s pop died.

But yeah, that Men at Work thing is silly, really.

the bpm and lets say, shape of the song (if it were transcribed onto sheet music) are the exact same

listen to the chorus side by side for both songs, they start and finish each section at the same time. Seriously, my youtube doubler link shows this quite clearly, its indistinguishable if the lyrics start and finish at the same time or not, theyre so close.

Hahaha are you seriously implying that Enrique Iglesias has no singing talent?

This whole autotune thing is COMPLETELY different for him, which is why I liked it lol.

What about the case of a song that has been used, then remixed? Is this a form of theft, or simply building on the work of another person to create something different?

I don't think the issue here is music theft; if it was, then every modern artist would be a criminal. The fact that you found two (almost) beatmatched songs does not constitute theft. I concede that they do sound similar, but dance/pop music isn't a genre known for variety in its music. In fact, the reason genres even exist is because people make music in similar styles; it's not cheating, nor is it theft. It's human nature.

Take, for instance, this musical parody. Although it was made simply for humor, it shows that many modern artists write very similar songs (I-V-vi-IV for all you musicians). If similarity in music means theft, all the artists featured in that video would be dirty, smelly, rotten, mother ****ing thieves. But they're not. They're famous and filthy, stinking rich.

I don't particularly like it either.
