Being in the background does not prove or disprove any character as playable in Brawl.

And, just to add injury to insult, I'll show you why it doesn't deconfirm him.

The programmers of the game can easily program Nook to not appear in the background when he is unlocked and/or being played. *GASP*

The only Animal Crossing character to be 100% deconfirmed is Resetti.
