The legality of DLC

Assuming that there is character or stage DLC, do you think that these DLC elements would be tournament viable/legal? This also encompasses data that can only be gotten through connecting the 3DS and Wii U systems.

Anything from a system link will be legal (or at least, it would be unreasonable to make it NOT legal). As for DLC, I could see some small tournaments restricting its use, but I imagine all major tournaments will allow it (this is assuming none of it is out of normal balance bounds) as the vast majority of serious competitors will most likely own it.

I think that would depend on how balanced the game would be if DLC content is added.

In the case of Stages, they are somewhat irrelevant because you have Omega Mode.

The most balancing issues may come from the characters included in the DLC of choice. For example, take Injustice. Of the matches I have watched on Youtube, you are allowed to use DLC characters. However, if one of these characters is so unbalanced that they get the Meta Knight treatment (getting banned for good out of tourneys), then it will up to the tourney makers to decide whether or not said character will be available in a tourney setting (which, most likely, it will not be the case).

In that case, the person should just stick with the characters from the original game and not the DLC. Also friendlies could remedy this issue somewhat.

Literally every other fighter out there has DLC characters tournament legal. Why should Sm4sh be any different?

I can almost guarantee anyone at a tournament will have the DLC, but I'm sure they'd have it so people with DLC can play with people who don't have it.

Otherwise you'd just be playing for glory with other people who had the DLC and would segregate the players.

DLC is legal in every other fighting game that I know of. Kokonoe is possibly the best character in BBCP and she's not banned.

I can see that being a valid concern for smaller local tournaments, but anything of moderate or large scale will almost certainly include players who have all of the DLC. Odds are they'd not be travelling to compete in big tournaments if they couldn't afford a cheap character/stage pack.

IIRC, in MvC3, you could use Jill and Shuma-Gorath in the competitive stage? And those were DLC.

I see no reason for DLC characters (if that's what you mean) not being allowed in tournament play. Considering how balanced Sm4sh is compared to the previous entries...

For local 3DS tourneys? It feels like there will be a difference for people with and without DLC.
For Wii I expect it to be 100% legal.

Um...patches are bound to balance the games. (I'm not sure about dlc, but why would they release dlc that 'un'balances it..?)

The only reason it wouldn't be legal is if it was inherently overpowered/bribing your way to victory (Kat/Isaac Clarke in PSASBR, who despite being legal still had tiers of their own) or if something happened to make it not available to new players, putting them
at a matchup knowledge disadvantage (Jill Valentine/Shuma-Gorath were banned in UMvC3 after Disney purged all records of the game from digital stores).

Anything else would just piss everyone who liked the DLC characters off.

I'm sure DLC will be viable, they usually just download the content in a patch and then you pay to unlock the extra content, that way you can easily play against the DLC without splitting up the playerbase.
