Smash Wii U Replay Function and Copyright Strikes.

By now it should be known that Nintendo will claim rights to anything you upload to youtube that has/uses something from one of their games.
With the new replay feature it is good to keep in mind that certain songs in smash will automatically Give that video a copyright strike meaning if it happens two more times your youtube channel will be terminated.

This happens because of youtubes stupid copyright claim system.

The songs that will give you a strike are (There might be more. these are what i know of if there are anymore post it in the comments and i will add it to the list and give credit)

Live and Learn
Super Mario Bros 2.- Overworld theme
certain songs on Gaur Plains
Cloudtop Cruise- Ryuki of Spiral Rhapsody

Your best bet to avoid getting a strike is to turn off your music from the game settings or putting non-copyrighted music over it.

Sorry if this has happened to anyone but its youtubes automated systems to blame

Nintendo will revoke the strikes. I got one on the Pikman 3 song that literally has nothing but chirps and whistles. Nintendo took away the strike within 24 hours.

This is a bit off topic, but you may want to consider using a different text color, as your current color is very hard to read on the default dark themes.

Can anyone else confirm this? a friend of mine still has his strike from a few days ago. the song was live and learn

This is a bit off topic, but you may want to consider using a different text color, as your current color is very hard to read on the default dark themes.

They are. Nintendo might've been sponsoring EVO but the main reason Gaur Plains was banned because the dont have the correct licence to the music

A Sonic song being responsible for strikes... is "eLicense" claiming the videos? They were taking down almost all Sega-related content without Sega's permission.. more of a false flag kind of thing, back in February.

Still, it sucks to see this happen. Hopefully they go away in no time.

What the ****? Is this strike **** for real? Now I'm gonna have to think twice before posting replays on YouTube thanks to this.

Doesn't this seem quite strange? Mario Kart 8 has managed to get away with its YouTube uploads, but I guess that's thanks to the fact that their music tracks never change.

However, I'm willing to believe that it is still a thing, as Angry Joe and SomeOrdinaryGamers had trouble with that Nintendo strike bull****.

Fair use caps at 30 seconds or 10% of the work, whichever is shorter. A three minute match is long enough to break either, or both, of those rules.

Essentially, until Nintendo and Youtube both properly work out their copyright policies and rights-ownership, this is not only able to, but likely to, happen with any song not owned in full by Nintendo. Even those could get auto-tripped by Youtube.

Consider me the big bad Fox int he room for saying this but I've always been against the replay feature from the start. I'v'e really never seen any benefit in having it. You play a match, boom its over. For sharing with friends I can understand but putting it on YouTube is a whole another story, as this thread states (I'm still wondering if there's a way you can play online anonymously. Probably helps not to put your name in the handle like "Ben" or "Dylan", or any derogatory term for that matter so you don't get ridiculed if the replay is put online for the whole world to see).

In any case, I'd try putting in some type of copyright notice in your description of the video that the music is exclusive property of Nintendo. Or of course, you could turn off music altogether and keep SFX on. Hope that helps.

It's also useful for showcasing glitches for people who lack streaming equipment/internet speeds.

The time limit makes it hard to really use for proper matches, but that doesn't make it a useless feature.

I would of thought they would make exceptions since the whole Youtube feature had come out. I haven't necessarily gotten any strikes yet myself but the second Replay I had ever uploaded to Youtube got an "Matched Third Party Content" notification.

It happened to be the Peach's Castle Stage with the song "Slide" from Super Mario 64.

I didn't get a strike and instead my replay has ads that appear now. So naturally, I thought they would of done that with a few if not all. But getting actual strikes for using a function they're allowing us to use? That's just plain silly. As for your suggestions to avoid getting strikes I think it'd make more sense to just turn certain songs off on certain stages to avoid it instead.

After all, we have the ability to change how frequently a song plays on a Stage or to make sure that song never plays at all. I'm not sure if that applies to online matches though, but I don't think I've ever gotten a song that I've turned off on certain stages online.

That being said I do believe it would be useful if a list of "Songs to avoid" with the Youtube Function were kept and updated. I hope if any others read your thread they'll pitch in their findings on specific songs. This was definitely something I didn't know till now.

Aye, I don't have nor have the money for video capture equipment myself so I can relate. I didn't think of it being a way of pointing out glitches though, maybe that's something the developer can keep an eye out for too .

This is the exact situation that happened to me, only I was playing on Delfino Plaza with the Delfino Plaza theme. The video puts out a little ad ten seconds into it. I figured it wasn't a big deal, but if everyone's saying I can get a copyright strike for it, well... I guess I'm just getting a little paranoid now.

Never really understood how you can claim a song in a game but you cant claim the game. You'd think that if the song was being played through a game that it was given to, and not ripped out for other reasons, that the claims wouldnt mean jack.

Almost every single claim issue i hear about is revolving around the music the game has, not the game itself. So stupid.

I got flagged for the Delfino Plaza theme too, so I'd suggest adding it to the list.

The SMB2 theme has always been an issue- I got flagged for it even back when I had videos of Melee.

It's not that nintendo is the one striking all the videos, its that YouTube uses an automated system and that system sucks really bad and can't tell the difference between video game video/audio and actual copyright stuff.
