Legality Question: Based on the recent events involving P:M, is general modding of Brawl and P:M dangerous?

Basically title. I want to keep creating more than anything, but if it involves legality issues like what happened with P:M just for creating a PSA or AI mod or something, I can't do that. As much as I love and care about modding this game, I don't want to get in trouble or get anyone else in trouble.

I'm not going to pretend I know anything about legal technicalities, but you would think that Nintendo would have tried to launch C&D's against everything to do with modding or IPs if they really wanted to already. I mean BrawlVault, brawlcustommusic, and even stuff like the Melee/sm4sh hacks and Super Smash Flash haven't been taken down. There will always be a risk with modding if the IP holders aren't explicitly supportive of it, and I'm sure people will continue to make new custom stuff knowing that anyway, especially if they never cared about PM or legal ramifications in the first place.

It just sucks that we won't know how dangerous that risk can be until Nintendo declares what its intentions are or already acts on them. We could speculate on possible recent events that may affect that, but in the end it will still be speculation. So I can only recommend to keep yourself informed of the situation - see what Nintendo does, see what modders do, etc. In the end you'll have to make a decision based on your values, and I know that sucks when you have both people that support the work you create and the actions you may take to keep your community safe. Just know that what you decide isn't permanent - you could continue until you find something more fun or less risky to do as a hobby, or maybe wait until things settle down before picking it back up..

As the PMDT say in their goodbye letter, the discontinuation of PM development was not related to any legal issues. As far as that goes, modding of Brawl, or any other Nintendo game, is in the same standing now as it was before. My understanding of the situation is this: Nintendo has specifically avoided officially recognizing or commenting on PM because they don't want to issue a C&D for it; if they ever officially recognized its existence, they would be forced to do so for legal reasons. However, Nintendo has recently been getting more involved in the competitive community, and have been giving support to various tournaments and organizations - as long as they didn't run PM. The PMDT stated that part of the reason they ended development was to avoid legal issues, and my guess is that they were fearing their involvement with the competitive community would lead to legal trouble. As far as I can tell, that's where the danger begins and ends: the competitive scene. Unless your mod is the next big thing in competitive Smash, it should be just as safe as ever.

I code my own AI for the Brawl/P:M, so the idea of it ever being a thing for competitive smash is pretty laughable. That being said, I am hesitant about continuing modding brawl after some closer examination of the law. I'm thinking I might message the attorney who P:M directed people to, see if I can get a clear answer.
