Smash 3DS Picking Mario softlocks my game

If I pick Mario, it goes to a black screen except for the clock bar at the bottom. To close I have to completely turn off my 3DS.

I had the same issue. I ended up borrowing a smash cartridge from a friend to install the update, and then redownloaded and mario worked
