Need good program for creating character

Hello, I am trying to create a character to place into brawl as a playable fighter. A huge task I know. However, I need to know two things before starting. 1- is this even legal? I mean, could I get sued for messing with the internal coding of the game? and 2- are there better programs for such a thing other than maya or programs like that?
