After reading through a lot of the nintendo banning the stream and subsequently allowing back, I'm hyped as **** for this weekend. That being said, I want to address the topic as a whole and consolidate a lot of what I've been reading all into one place so we can better see the whole picture and react accordingly if this situation were to ever arrise again.
First of all, nintendo has 100% ownership of it's games. I know a lot of you guys are going to throw fair use law at me but I'm going to tell you here and now that if this ever happened again on a more serious note, that would never work in your favor. Given how nintendo treated this whole debacle, it was most likely a publicity stunt to try and appeal to gamers, showing that "hey we have the power to do this, but we are merciful so love us again." That or just some people on the legal department didn't go through the right channels before shutting down the stream initially, it's not like the heads of nintendo said "hey look they are going to stream smash, stop them." Most likely how it went down is a guy in a desk working for nintendo saw it, checked his protocol on his desk, and shut it down. When we responded how we did, it went above that guys head into more serious hands on the legal team and we got the decision we did, that we could stream. However, a lot of what I saw during this is "what right does nintendo have to shut down the stream, I don't see anything that would be copyright infringement." Nintendo has some of the best copyright lawyers in the business and I highly doubt that you could tell them what is or isn't copyright infringement. You're never going to win a legal battle on what is copyright in the eyes of the law, they can pull a million different things from music and sound effects, to any animations that are shown. That is not the right way to approach it.
The other thing that will not work if this does again happen is trying to start an anti-nintendo campaign. Hashtags like #****nintendo are just going to justify their actions, since if you're going around saying **** nintendo, you're not representing their brand in a way they see fit. You have to act mature and level headed, you can't just try and **** talk your way out of this you have to do it cleanly.
The best way, especially that I saw was showing nintendo why we want it and how it will effect our view of them. We are a big community and so is the fighting game community as a whole. We are a huge voice and the more message we sending them saying how we raised all this money for breast cancer, that we enjoy the products they make even years after release, that we would really appreciate it being allowed to be shown because no money is being made, that's the right way to approach it. It's their content, its our job to show them that we care about it and be vocal. It also doesn't hurt to say that this negatively effects the way you see the company (in a POLITE WAY PLEASE), that this sort of decision effects any future business you want to do with them and how you talk about their brand and products to others. If a few thousand people say this, it's a potential market they lose out on and they weight that decision.
