Kirby's FS intant kill?

I heard that Kirby's FS is killer! especially in a free for all, all you have to do is go up in the air until you get in that magnifying glass circle, use the FS and everyone gets stared ko'ed. That is awesome!

1) If you go in a magnifying bubble, and your opponents are still on ground, you wont catch them.
2) Kirby's Final Smash can be avoided with a simple spot dodge.

It's not an instent kill unless you foes are above 100% or around there.
