I mean, there IS an sd card slot. this would be the same exact game as the wii version, i know that isnt possible but still I'm curious.

I'm sure Nintendo knows about the custom stage exploit and would fix it if it was ported/re-released by them. Also I don't think 3DS games are moddable yet.

Isn't this kinda a ridiculous speculation thread? No, if Nintendo remade Brawl for some reason on another system, a very specific exploit would likely not work, nor would the hundreds of pokes in memory that make the game function as it does.
