Class-Action suit avaliable for Pre-Orderers

Check the terms, if they guarantee or warrant the good by the certain release date (say December 3rd) a possible Class Action suit for Breach of Contract may be available against Nintendo and the retailer you purchased the product from. However, it will be hard to get damages outside of the price of the good (refund of fifty dollars). The way you could argue is if you planned a trip or event around the good and you relied upon the good to your detriment. If so then you could get more then the refund of fifty dollars. Also the joining of all pre-orders would lead to a larger verdict.

However, I do feel that Nintendo should do something for Pre-Orderers such as a rebate. (BTW I did not pre-order it).

We're mad at Sakurai and Nintendo right now. But we're not going to sue them. We just have to cop it on the chin and then we WILL end up getting the game. So relax a lil'.

This will kill Brawl's sells, because retailers aren't going to advertise or buy as much copies like they did with Halo because they have been letdown by Nintendo. Nintendo needs to seriously add something or give a rebate for pre-orders or something to show good faith to retailers and customers.

No, game sales people dont care, especially for people that have preordered. They're laughing all the way to the bank, where they make interest on your preorder money.

Yes, but stores make more off the sales that day then pre-order and they are losing money for the sells that day.

Just like every other Nintendo game that was delayed lost sales...

The game's gonna do just fine, anyway. People are still going to buy it, and it won't be hurt... well... besides the people who'll be buying MGS4 instead of Brawl.

You're an idiot. You obviously know nothing of how the industry truly works. This will not hurt them. Hardcore gamers will buy the game regardless, and casual gamers don't even pay much attention to release dates.

Except I'm fairly sure pre-orders never guarantee an exact date. They have lawyers who write that stuff.

Generally they say something along the lines of "this date (or date of stocking)".

Also, you cannot even touch Nintendo since they are not involved. You pre-order with a third party. Nintendo never sanctioned them to give out pre-orders.

However, you have demonstrated why I don't pre-order games so far in advance.

Every word within the above quote is absolute fact.

I was in Gamestop the other day behind some woman and her kids in line. The line was rather long, so they were just kinda looking around. One kid saw a display box for Brawl and got excited and told his mom that they should get it when they got up to the counter...

Not to mention how many friends I have who loved Melee but still have no clue when Brawl is/was supposed to be released.

Nintendo delayed the game to increase the sales, you complete nincompoop.

They did it in Japan to get more supply, they did it in America to get more supply and more advertising in.

This is only gonna help Brawl's sales in the end.
