Yoshimitsu first appeared in the original Tekken, as a ninja-samurai mix fighter who uses a single katana. However, over the years, he has changed weaponry(lightsaber(s), dual katanas, tennis racket), outfits, and even joined the roster of the Soul titles. He has appeared in every Tekken, being one of six characters to do so(others are Nina Williams, Heihachi Mishima, Kuma and King), and has appeared in every Soul title since his debut. He would be an interesting character, repping both Tekken and Soul, but let's start with some arguments.
Arguments
Sakurai has already said he won't add fighting game characters! Well, Sakurai has never gone against his word, has he. The Villager is a perfect example, as in Brawl Sakurai said that an Animal Crossing character wouldn't make sense in Smash. However, a fighting game character would make more sense, and would be quite easy to implement.
Sonic, Snake and Mega Man are enough third parties for Smash. Well, that's a matter of opinion, because you aren't creating the game.
Pac-Man should be the Namco rep! While Pac-Man serves as the main mascot for Namco Bandai, that doesn't give him a free pass. In Playstation All-Stars: Battle Royale, Heihachi Misima represented Namco, and in a tennis game on the PlayStation called Anna Kournikova's Smash Court Tennis, along wiht Heihachi, Eddy Gordo(also from Tekken), and Pac-Man as well.
Now, onto a moveset!
[spolier]B: Ninja Vanish: Yoshimitsu crosses his arms, and disappears into shadow. He then will re-appear at the most 6 character spaces away, and slash with his sword. In the air, he just teleports.
Side B: Sword Hop: Yoshimitsu sits on his sword, and has a single jump and can thrust forward and backwards to move and attack at the same time. He falls off if hit or if he performs an attack.
Up B: Sword Helicopter: Spinning his dual swords, he lifts himself into the air, while laughing.
Down B: Indian Stance: Yoshimitsu sits on the ground, cris-cross style, and slowly heals. He is vulnerable during this time, and he heals 2% per second undisturbed.
Final Smash: Feudal Showdown: Yoshimitsu is surrounded by petal blossoms, and he erupts slashing his sword in a style similar to Samurai Goroh's AT, except you control where he goes. It ends after 20 seconds.[/spoiler]
