Plenty of characters in the history of Smash have been included before they appeared in their first proper game.
One of the latest examples being Greninja. At that point in time all that existed for him was concept art for his inclusion in Pokemon X/Y and Sakurai essentially just made up a moveset based on those drawings. Smash Bros has always taken the liberty to use creative license when needed.
Playtonic already have an idea of what abilities they want Yooka-Laylee to have and have early Alpha footage with various attack ideas already.

The team that worked on Banjo-Kazooie and it's sequel Banjo-Tooie left Rare a long time ago and the Rare that exists now is not the same one that made the many classics we all know and love.
The majority of the developers over at Playtonic are ex-Rare employees from the day when Rare wasn't a laughing stock forced to make Kinect games.
Even though Phil Spencer from Microsoft has stated that he would like to see BK in Smash he does work for Microsoft. It most likely was said for some positive publicity to be thrown Microsoft's way in a time. The idea of Microsoft and Nintendo working together on anything is also hopeful at best.
The Banjo-Kazooie we most likely would get is the Nuts and Bolt version. That game did not do very well and his redesign was not received kindly by many.

Yooka-Laylee's release date is slated for October 2016. Taking into account how long it takes to develop a character they could have him ready by around that date. Nintendo could include a promotion like with Mewtwo. Pre-order Yooka-Laylee for Wii U and get Yooka-Laylee for free and 2 weeks early.
