I think Diddy Kong almost made the cut for Melee because King K. Rool and Dixie Kong had trophies in that game, but Diddy Kong didn't for some unknown reason. I think the reason he didn't have a trophy was because he was planed to be in the roster for Melee just like the other Brawl newcomers like King Dedede, Wario, and Pit. Rareware left Nintendo less then a year after Melee came out, so at that time they still owned the rights to Diddy Kong. Nintendo and Rareware's relationship starting coming apart during that time, so Rareware probably didn't allow Nintendo to put Diddy Kong in the roster or he didn't get in due to time constraints like King Dedede, Wario, and Pit.
